What should a proper settlement agreement cover and contain

In order settling any dispute, a written settlement agreement, agreement of loss or however it will be called, needs to be drawn up and properly signed.

The agreement needs to name the parties and their details, who will be entitle to what, when payment or repairs are due, what the value of the compensation will be and a clause of full and final settlement, once fulfilled.

It must be noted, that this clause, once signed is binding and there are no further claims or actions successfully possible.

Any Insurance company will supply such waiving clause, before fulfilling any pay or repairs to 3rd parties and in a similar form to a comprehensive insured client.

A 3rd party claimant, signing and taking the compensation, cannot in a later stage, if he/she found out it wasn't all as thought off, claim again shortfall from any party, or the driver/owner.

Any settlement contract should be understood and accepted, before signing. Issues of values contained in the settlement such as market value and/or salvage, should the car be damaged as seriously to be called a "write off" and must be evaluated before concluding the agreement.
