General Conditions
Subject to the terms and conditions as set out in this policy, RAMLA undertakes to support and/or pursuit members listed in the membership application and for your/their described vehicle/s listed within the application form, for expenses occurring for actions RAMLA Road accident management undertake in claim service to enforce or defend the vehicle accident claim for the covered member.
You are indemnified for cost arising for RAMLA claim service but not for attorney's fees in the accident matters, if it will be necessary to escalate matters to a court of law, next to RAMLA Claim Management efforts in pre-litigation, when mandate an local attorney to pursue the matter, provided that the membership fee is paid in full and received by or on behalf of RAMLA in advance and in accordance with RAMLA prescribed schedule of procedures and tariffs prevailing at the time of the covered event. Membership will be for one year and automatically prolonged, if not cancelled.

A serviced event means:
1.1 Vehicle accidents with third parties occurring for traffic registered areas or in public traffic, where the member and the with RAMLA registered vehicle, are involved in a motor collision and a party in this accident.
1.2 The indemnification will only serve to enforce material damage compensation claims against the responsible person/company in the accident matter, and not for claims of bodily injury etc.
You must be involved in a vehicle accident on public roads suitable and prescribed for public traffic, and be the, or one of the parties not responsible for the occurrence. RAMLA will only serve the material damage.

2.1 A covered matter shall be based on, and entirely served in the content or the written amendment within the membership application, in hands of RAMLA and the herein prescribed person/s and vehicle/s.

3. Matters not covered
3.1 Bodily harm of any involved person
3.2 If no reasonable prospect of success, carefully examined solemnly by RAMLA administration, will be found.
3.3 RAMLA is not liable and not obliged to execute a legal matter in a South African court of law, that is in favour of the member, but without reasonable success, against another party. If RAMLA agrees to do so, it may be according to special conditions and extra fees. In the case the member does not agree to the before sanction, RAMLA will cancel the matter and hand the file back to the member, for his own consideration. All cessions given to RAMLA for this special file will be automatically receded with retrospective effect, together with the written notice to the member.

4. Membership fees, Limits of indemnity, Payment of Claims, other common duties to mitigate
4.1 your membership fee has to be paid to RAMLA
4.2 the first amount payable must has been fulfilled
4.3 Limitation for support in pre-litigation, all before the first instance of a South African court of law needs to be approached, unless RAMLA out of its own capacity suggests, to extend legal actions, or approach a higher court, which all may be subject to special undetermined requirements, which are discussed prior with the member.
4.4 For not more than two supports a calendar year
4.5 No claim even, if successfully settled, will be paid by RAMLA. Any claim in favour to the member, must be paid by the third party.
4.6 Your accident forms and additional information must be complete and reflect the full truth; otherwise the member will be liable for the cost of all and every action, including RAMLA pre-litigation work, court, attorneys and/or other fees.

5. Commencement, Duration and Payment of membership fees

5. Commencement, Duration and Payment of membership fees
5.1 The member must pay the membership fee monthly, quarterly, half yearly or yearly in advance, before the 13th day of the payment period chosen.
5.2 If the membership payment will be on a yearly basis a discount of 10 % of the net amount will be granted. If the membership payment will be on a half yearly basis, no discount will be granted. Membership payments quarterly, will be subject to an increase of 5% the nominal membership fee and monthly instalment have to pay a 20 % extra handling fee, to compensate cost for billing and control of payment.
5.3 Membership service starts after the first payment, for cases occurred not before one month after the first instalment is paid to RAMLA, at the first of the following month. Other needs can be covered by special arrangements.
5.4 RAMLA reserves the right to amend the terms & conditions of the membership from time to time. In such case the member shall be notified in writing. Upon receiving membership fee payment, subsequent to any such notification having been sent, it will be deemed that the member has agreed to the relevant amendment or amendments.
5.5 No person or company is authorised to receive membership fees from a member on behalf of RAMLA, unless such person is in the possession of a written authority form the RAMLA to do so.
If you obtain membership and receive your confirmation i.e. at the 24th of the month, the service can be affected at the 1st of the full month after the confirmation date.

6. Service Procedure - Requirements
6.1 You must inform RAMLA of an accident as soon as possible in writing by email, but at least within 30 days after the occurrence of an event, that may rise to service.
6.2 RAMLA will inform a member in and with which actions a member have to support the matter, i.e. furnishing all the relevant documentations, assessments, witness details etc, as well as to collect and to provide further details required, in which respect what so ever, according to the pending matter. If a member fail to do so, in the time laid out in the request, it may arise that RAMLA cannot act in the timelines to be followed in processes.
6.3 If RAMLA comes to the conclusion that a settlement between the parties will be the only successful way and the settlement will be reasonable for the member, the member is obliged to follow the settlement. If failing to do so, RAMLA will drop the matter and the member is liable for cost occurring thereafter.
If you do not correspond in time, it can be that RAMLA has to cancel the matter, while this will affect the reasonability of the success. It is therefore advised to cooperate in full.

7. Explanatory Notes, Basis of Operation and Variation
7.1 The summaries, examples, comments and explanatory notes in this terms & conditions headed as such or printed in grey italics between lines, wherever they appear in the body of these terms & conditions, shall not have any legal impact.
7.2 The member application for membership shall be the basis of and form part of this membership.
7.3 These terms & conditions and their possible amendments thereto, shall constitute the sole agreement between the parties. No alterations or amendments of the agreement shall be of any force or effect, unless reduced to writing and signed by either the signatory hereof, or by someone specifically authorised thereto in writing, by such signatory.
7.4 No representative or agent of RAMLA has the right to promise service, other than the service laid out in this terms & conditions or in RAMLA official publications.
If someone in the service of RAMLA promises you something not mentioned in this terms & conditions, you cannot rely on the information so given before you have obtained confirmation hereof from RAMLA in writing for that issue.

8. Cancellation

8. Cancellation
8.1 Should you not pay your membership fee and fail to pay it for a period of more than 30 days after the due date, your membership and service shall be deemed to have been cancelled, retrospectively to the date the relevant premium was due. No indulgence by RAMLA in this respect shall constitute as a waiver of rights.
8.2 Any membership fee we receive after cancellation, shall have the effect of re instating the membership, but shall be considered as a first membership fee of a new membership, in which respect the provision of clause 5.2 shall operate with respect of commencement of service.
8.3 RAMLA may cancel the membership upon 30 days written notice to the member, to the end of the period the last membership fees has been paid.
8.4 The member may cancel the membership, upon 30 days written notice to RAMLA, after the initial period of the first year of membership has expired.
8.5 Should the membership be cancelled in terms of clause 8.1 or 8.3 above, any service required by the member for any service covered under the membership before cancellation, must be made within six (6) month of the event, being under service according to terms & conditions. Failing that period, RAMLA will have no liability to the member in respect of the requested service.
8.6 If the membership is cancelled, at any time for any reason, except if cancelled within the first month of the confirmed membership, the member shall not be entitled to a refund of membership fees paid.
8.7 The member will be liable for cost occurring out of unpaid debit orders or dishonoured check payment, according to costs published by RAMLA.

A RAMLA member can always inquire about any matter in regard to traffic legislation or any other aspect in regard to safe driving or prevention of accidents and what may be a problem in terms of motor vehicle damages.
