Im caught between a rock and a hard place here and im hoping you can shed some light. A company driver hit me as he was trying to beat the traffic by going into the wrong lane now facing on coming traffic, he tried to go back to the correct lane but there wasn't enough room for him so he came too close to my car and hit my side mirror and it got shuttered (Driver's side). Some green liquid came out when the mirror broke and spilled on the body of the car and it wont come off, so i have two problems (Messed up paint job and im side mirror less) .

I drive a VW Touareg V10 and it will cost R28 000 to replace the mirror and fix the paint job. Now these are the costs im not willing to bare as i didn't do anything wrong. Everyone was stuck in traffic and he decided to be adventurous but i got to pay the price of his stupidity. His car wasn't damaged at all but im left with a side mirror that can give in any day.

I called the company he works for and they said they do not deal with individuals. I must go and claim from my insurance, why should i be the one claiming? I did nothing wrong. The insurance wants an access of R5000 which i don't have and I was on the right lane waiting for traffic to flow. He's the one that hit me. Please advise if im missing something here? Your help would be really appreciated in this regard.
