The South African insurance company insisted consistently, not to take over the scrap for disposal, and did all to leave the task to a single mother, a woman without any experience of dealing with scrap motor cars, to dispose the salvage, in an attempt deducting the full amount of wrongly calculated salvage value, from the pay in the settlement offer.

The matter could not been resolved with the insurance company, and due to the high differences had been taken to court.

Salvage can have significant value.

For example: your car value (market value) is R 190 000.00 and the repair cost are assessed to be R 210 000. According to the law of South Africa the case is, just to compensate the present market value of R 190 000.00, so its a "write off" matter.

What about fees, must they be paid upfront or can it be deducted from recoveries?

Let me answer the question in short.

Yes, all fees need to be paid up before we take action.

Why is that so?

Our fees are as competitive low, that we cannot enforce any such fees economically, if someone just take our services and thereafter give us hassles to pay.

Any local attorney will do the same, as asking for a deposit, commonly far higher than our entire fees are, upfront.

In general those deposits are offset against fee notes and further deposits requested in due course.

We dont do that. We deliver services not billed on time issues, but on performance phases, which gives cost certainty and the assurance to be taken care of the full matter.
