Respecting and exercising care and reasonable driving must be expected by all motorists and others taking part in public traffic, in which ever way.
In public road traffic, no one have the absolute right of way but a number of duties to foresee, avoid motor car collisions.
Those duties are imposed on all participants, taking part in traffic. Not abiding to those duties, can lead to negligence, even if this motor car driver did nothing wrong in his/her driving, but failed to avoid the accident, despite there have been reasonable possibilities, available to him.
Motor car drivers can only claim not being negligent and/or contributable to the car crash, once they can proof having done all possible in his/her capacity, but not having had a chance escaping the impact at all.
Those duties are of high importance and it's not always easily proven, that indeed all had been done to get out of the danger, but couldn't.
The duties must be seen as going so far, that a motorist can be found negligent and liable or partly liable for damages, even if it's evident the other motor car driver has clearly been driving wrongful and negligent.
Motorist caught up in such scenario, must concentrate on proof that indeed they did all they could evading the car accident, but unfortunately haven't had any practical chance.
Foreseeability, a mayor duty - imposed on all motorists.
Observing on-going traffic is a key element of duties a motor car driver needs to abide to. The motorist must have a proper look out and observing the entire area of its immediate vicinity and concentrate on the traffic.
This includes controlling both sides of the road, from site to site including boardwalks, pedestrians and bicycles or motor bikes. Certainly the traffic in front a car driver must be observed as well as those behind a vehicle, by looking into the cars mirrors frequently.

It will be reasonably expectable, that a motor car in front, will suddenly and unexpectedly reduce speed or even come to still stand and consequently foreseeable.
Once a situation being regarded as foreseeable, it will be expected that the motorist adjust the driving accordingly, being able to circumvent a collision with another.

Ombudsman for short term Insurance (OSTI)
The Ombudsman for short term insurance disputes (OSTI) reviews matters that emanates from Insurance policy differences or disputes.
That means only contractual issues can be given for review and no 3rd party claims issues can be addressed to the Ombudsman.
Many people believe in objectivity and sympathies the Ombudsman may have to issues, believed to have been made unfairly by any Insurance decider.
It must however not always be expected that OSTI is in favour of Insurance clients to protect their rights.
Too often the decisions taken by the Ombudsman's office are backing the Insurance decision, particularly so as the evidence provided hasn't rebutted the Insurers argument, due to lack of knowledge.
