A sketch can clarify a lot and be better as many words.

One or two pictues of the damaged cars, best those taken at the scene of accident, can evenly help us understand better, to verify the impact or extend of damages.

In case of disputes i.e. with motor insurance companies, let us know the issue of dispute and if any written statement about a short-falling offer or even a full decline is available, kindly forward and comment on it about what is your position.

It will be helpful if a comment is made, whether a dispute arose from a 3rd party or a come from your comprehensive claim, against your own policy/Insurer.

Over many years we did analyse and advised on numerous cases, free of charge, regardless if damages be small or very severe, complicated in terms of evidence or reluctant behaviour or of any other nature.

The RAMLA web site is a comprehensive and specialised platform, dealing with all sorts of issues of motor car accident or road traffic damages matters, particular with the question of compensation and give answers to factors of dispute or problems in compensation claim matters.

As the RAMLA web site is information orientated and do not strive for best design or sophisticated method of use, finding all one may want, you need to go via the keyword search, if the internal linkage isn't good enough.

Should a valued reader do not find what will be reasonable expected to be found, given it is a part of car accident issues in South Africa, you are welcome to inform us to check and if we can improve.

What you rather should not do, don't copy us a complete file of an on-going dispute etc.

We should know what is at stake in simple terms, before we request further information.

If you provide us with pictues, kindly reduce to a density of below 2 mb per pic or even less, as that will be more than enough for review.

Thank You
car accident in South Africa

What you rather should not do, don't copy us a complete file of an on-going dispute etc. We should know what is at stake, before we request further information.

The favourable way on an initial contact is by email. You will get a reply relatively soon, commonly within about three hours or the next day, if late. We take the information provided and reply with what we think of it and how to go or what we like to be provided with additionally, to understand the case in full.

Our claim management on duty can even be called over the phone, but don't just do so, as you know there is a possibility. At least you should prepare yourself of what you like to get across. More complex matters should in any case be submitted in writing by email, before calling, in order for us to have an understanding of the problem.

Kindly note that telephonic conversations cannot be studied twice, as we can do with emails, to get the full information we need, avoid misunderstandings or just don't get the important matters of the issue across. Keep in mind sometimes bad phone line quality.

It will be much better contacting us by email first, and once you got a reply - which will commonly be soon, in about one to three hours' time usually, you may call us thereafter, if there is something to clarify which can be done better over the phone.

RAMLA will be there for you when you have time, even at evenings, weekends or holidays, we do reply quickly. Should that out of some reason not be the case, your matter will be attended asap.

RAMLA - car accident damage claim service South Africa

What RAMLA - Road Accident Management & Legal Action - can do for you, with our initial free advice, or later perhaps by pursuing your case on your behalf.

South African motorists caught up in a traffic accident, may be in need for support, in order to get paid for car accident damages, suffered in a crash on public roads.

Taking on the challenges coming with a vehicle collision and subsequent damage compensation, can create some headache, despite one should think such matters may be sorted out easily.

Just contact the perpetrator and/or the motor insurance covering him/her, and addressing the matter will not always trigger a solution, and may destroy the believe in a fair and reasonable outcome.

A reader of this page wouldn't be here and found some, hopefully valuable information, about all sort of motor accident compensations problems, if there wasn't a problem at all.

Before elaborating unchartered territories, don't hesitate and contact RAMLA for a first, free of charge, analyse of your particular matter.

What should be included in a case briefing to RAMLA

We did explain what is meant with our free first advice, but like specifying what is good, important and suitable to include in such a briefing.

1. Concentrate on facts and try to eliminate frustration or emotion when drafting your briefing of what happened.

2. Formulate what had happened with your own words, even if you will approach the matter in some subjectivity, but abide to the correct facts. Include, if there is any admission of liability or decline of such.

3. Drawing a good sketch, easily done by hand, showing the area around the accident, the most important traffic signs and limitations, the participating vehicles in its positions - before - during and after the impact to still stand, positions of other traffic and witnesses.

4. Photographs from the scene, best if all cars are still standing in position, before moving to a safer place, even if instructed by a police official to move.

Convince those officials, that this moment to take a picture won't harm, but can help a lot in a dispute for compensation, is worth the effort.

5. One or two photographs of all the damages, not only your own - but if possible even those of the other car/vehicles, even those taken later after the car been taken to a safe place.

6. Photographs of the damages of others, if not clear in those pictures taken at the scene. It will help determine the causation and damage values of others.

7. Repair quotation or damage calculation or value assessment reports - Quantum

8. Letters of demand or decline of a claim

9. Disputes documentation which show reasons for the dispute in a claim

10 Other important information - Expert investiations - reports, witness statements etc.

It will take some of your time to prepare and send such documentation, but it is the only way to step forward and worthwhile the effort. You can help to receive a speedily reply, if you take care that pictures and other files are not submitted at high resolution, rahter smaller in size initally.

car accident in South Africa      car accident in South Africa      car accident in South Africa      car accident in South Africa

RAMLA will check the briefing, which is expected to be send via email   ramla@ramla.co.za, accompanied by some essential documents, such as an insurance decline, a sketch of the developing accident, showing all participating cars in position, before - during and after collision -, some photographs about damages or the scene of the accident, which often can explain more than a lot of words (kindly resize pictures to below 2.5 mb each or even less), or supply us with other information, needed to understand the case precisely.

Don't just copy a complete set of actions, already pursuit with a party or an insurer and expect RAMLA to cross check your matter, by working through all such documentation, for a second opinion.

Start with a briefing in your own words, what had happen, what do you think is the problem or problems and we take it from there.

Should more detailed and further information be needed, RAMLA will let you know, in our initial reply, relatively early after you contacted us.

We will advise you as an inquirer, about our findings and try pointing out a way forward to a solution, either in a claim action or in a defence against unreasonable or inflated claims, free of charge within such first inquiry.

But kindly don't expect RAMLA as an professional expert in all MVA matters, disputes, claims or defences, to pursuit a claim practically and find solutions, within such free analyse option.

Practical claim pursuit needs a paid, but absolutely affordable mandate. Get the support and solution you need, from one of the most experienced and specialised MVA (motor vehicle accident) experts in South Africa.

If you want mandating RAMLA, we start with a small registration process and once our service is activated, we work to solve matter for a client starts

After you studied and agreed to our service and fee options, contained in the RAMLA service and fee scheme, it will be accomplished by a request form, you may file and return, if you are certain you want to go forward with us.

In case you like to mandate RAMLA, to pursuit your matter, we start with a detailed analyse of the case and the handle the full process of demand for compensation, initially in the pre litigation phase, to get your compensation paid, or act on your behalf in defence against unreasonable or inflated claims, whatever your particular matter requires.

RAMLA will go all the avenues finding a successful settlement for a client, do all to avoid legal action in a court of law, for a reasonable and capped (one pay - full action) fee.

Once a potential client decided to mandate RAMLA, we need admitting, that our fees must be paid up before we engage in actions. They are too small to enforce, if a reluctant person just like taking our services and utilise the solution, but decide not paying our fees. Unfortunately we have had that too many times, so there is no other way as to comply or look for other options.

Our particular business concept concentrate inteligence, man power and office service in one central office and don't offer a client a face to face meeting in a local RAMLA office.

We do know and respect, that this may not be everybody's choice and those who do like discuss matters in person, make time for appointments, visiting the local offices just to get the message across, should do so, best with an experienced local attorney, but must contribute the time and even pay for such consultation, sometimes the same amount RAMLA offers to do the full pursuit.

We work via electronic media with our clients and stakeholders in the claim process. That needs to be accepted if working with RAMLA, accordingly.

Next to the financially benifitial terms, RAMLA is one of the most experienced MVA (motor vehicle accident) specialiesed expert in South Africa, which will certainly support the success of a claim, dispute or defence matters, in favour for the RAMLA client.

Once a potential client is convinced of our capability and accept the way we work, a mandate can be requested by supplying RAMLA with the personal and residential details of the new client, triggering a written confirmation entailing all the information a client needs to know to activate (pay) the mandate.

It is however highly appreciated, that such a service request will only be forwarded, if the client is willing and capable to activate the RAMLA mandate in a short period of time.

Should there be any difficulties fitting the mandat fees into the budget, rather wait until the funds are available.

What does it mean: RAMLA car accident claim management

You are looking for good, professional and deceive claim support to best economic conditions? Certainly you can expect and get this from RAMLA.

RAMLA offers you a quality support in motor vehicle or car accident matters for lower fees as others may offer, as we cut away overhead cost and rental for offices and stuff needed to run such local offices etc., but don't compromise on intelligence and training of our headquarter stuff to provide such ambitious legal support, for your damage recovery in car accident matters.

If other's maybe just promise something like that, RAMLA makes a difference as we organised our basics more competitive and customer/client friendly, so we can keep our promises.

One of the reasons we deliver quality and more for less, because we specialise in just motor car accident damage recoveries.

We act from a central office in the Western Cape of South Africa, but pursuing claims nationwide for clients. A large number of mandates comes from Gauteng Province.

Our medium of correspondence is the effective and cheap internet based e mail. We don't rely on face to face meetings, just to please you with a face. We don't waste time (time = money) in person to person conversations. Motor accident damage claims are based on facts and not on conversation.

Remember, personal or telephonic conversations are time consuming and sometimes badly ineffective. Just having a meeting means: make an appointment, get to the offices, have your (most often short) conversation, drive home and pay for all those time and movement.

Attempting avoid those ineffective factors, are some of the many reason for our ability to keep our promises to give you more quality service for less fees.

Think about a message a South African legal protection insurance policy provider like to get across - we provide you with the toughest lawyer to the cheapest condition - Does life work like that?

We do offer a variety of support options, starting with a detailed analyse of your individual case and a comprehensive advice how to proceed up to a full claim pursuit in pre-litigation (all we do before legal action in a court of law is unavoidable) or in the pleading and/or litigation phase (legal actions in a court of law) once a decision is made taking the matter further, whereby litigation needs regularly a corresponding Attorney holding office in the area of the court of jurisdiction.

RAMLA don't maintain local offices all over the country

One of the cost controlling measures in the RAMLA concept is, not to hold offices all over the country. This means you cannot just make an appointment to speak to your RAMLA claim manager in a local office, but you can talk to them over the phone and/or preferred by email.

For those who prefer a personal chat/meeting, an appointment with the local RAMLA correspondent attorney can be arranged, but unfortunately that comes with the costs to pay them, for such appointment.

Corresponding with RAMLA electronically is a proven working strategy and will comfort anybody with easy exchange of facts and data, not even needing the time to make appointments, take time off to get to the offices, and save any such cost for consultation.

It has been proven over the time, that telephonic discussions don't add much value to solve a problem, as the emotional aspects outweigh the factual statements. Given the accepted truth, that motor car accident compensation matters are to deal with on facts, little will do better as a written statement, and send via email, as a quick, easy and commonly reliable communication.

A telephonic discussion however can be very useful, if decisions needed to be taken or matters discuss in principle, either to evaluate a settlement proposal or escalation of a matter, so to discuss the pro and cons of the options available.

Executing the clients claim, means get in touch with all relevant parties involved. Those, as the 3rd party or the insurance company, witnesses or the assessment experts, all reside in different locations. Interacting with them properly, does not require being a neighbour.

Any local member of the legal profession, can probably be a neighbour of the client, but not of all stakeholders or even holding office in the area of the court of jurisdiction.

If a matter cannot be solved in the pre litigation phase and needs to be taken to court level, a local correspondent attorney will serve all the local requirements in the legal process.

For those clients, don't want to waste high local attorney's fees, and beeing prepared to cooperate and engage in a matter personally, proper briefed and provided with the actions according to the rules of the court of law, they can pursuit the local legal action with RAMLA directly, in the further process, one more time to lower fees.

This procedure however can bear some risks and is not suitable for anyone.

Isn't this you are looking for, an effective and affordable way to claim for damages?

What is needed to have a successful or strong case and win a car accident damage claim?

A case of motor accident damage compensation is one of facts and not of emotion. Adherence to traffic regulations, additional duties imposed by precedents and obligations interpreted by our courts, are the factors deciding a case.

Winning a case isn't a magic matter, it's just a combination of positive and negative facts and the ability and experience to present the case professionally and more importantly, preparing the matter of evidence properly.

Unsubstantial allegations, wrongly cited contract obligations or other questionable arguments or proof offered, need to be addressed and rebutted and factual evidence presented in order to set matters in the correct light.

Some of the Inquirers ask about our success rates. Well understandable, but the answer must always be, RAMLA can only enforce matters, which are backed by evidence. Bad evidence equals bad chances, good evidence however pave the way for success.

Should a party be unlucky correctly deemed and identified to be the liable party, the best to be done is to mitigate the claim, as good as reasonably possible.

A good accident documentation will need having: photographs best those of the scene of accident, a sketch showing the situation right after the impact, the involved cars in the place, before the impact, at impact and where they came to still stand.

A look around for any video camera installed, either at robots or other installations, such as residential gates or private houses, should be taken and if found, contacted to get some footage as evidence.

Some sophisticated motorists, do have on board cameras installed, which can be a good tool to find the proof needed.

It should be looked out for witnesses and the contact details taken. Own notes will be very helpful as one should not rely on a police accident report only. The police accident report focuses on violation of traffic regulations and not on support of civil compensation actions.

The damages should be photographed as good as possible and proper repair quotation, listing all needs to repair, should be at hand.

Wining and being successful with a claim for car accident damage compensation, it should be understood that it is not a magic thing being awarded for what is fair and in full. A strong case must be based on facts that will have proof.

Next to factual evidence, eye witness testimony, is one of the best and most successful evidential proof, provided the witness is credible.

If you mandate RAMLA to handle your compensation claim, RAMLA supports you by advising what information's and details must be assembled to build up necessary proof and evidence. This must be understood that you - the party involved - must support RAMLA claim management actively, to improve, if your documentation is lacking and not suitable to proof your merits jet.

RAMLA often observe that victims looking for compensation just gathered some data, relate those to RAMLA and do think all works from alone now. Unfortunately this is not the case. The time when all works on RAMLA based actions and do not need your direct involvement, will be when the claim basis - proof and evidence - had been established.

All then can be managed by your RAMLA claim manager to demand and pursue the case, including the initiation of legal actions, depending on the mandate you may give to us.

No claim has any chance of success when the merits cannot be proven.

Road Accicent Management & Legal Action - South Africa

How going forward once there is a claim or dispute or other challenges?

Well, once someone checks a web site as this one RAMLA presents, there will be some sort of a problem.

Motor Vehicle Accident (MVA) issues are manifold and can be complex.

It may either be that there is no response from the liable party's Insurer or a repudiation, apportioning or any other decline, such as to violation of terms and conditions.

There are even cases, where a claim is directed to a 3rd party, deemed liable and demanded, but no engagement noticed.

Lot of issues coming up in MVA - car accident matters, may not be handled according to valid law, or wrongly interpreted.

There are many people in South Africa's motor insurance industry, without a legal background and act under instructions, don't care, nor perhaps not having the necessary skills, or just follow a strategy, to get rid of valid claims.

Such should not be accepted and the challenge taken head on, even if it comes with some engagement.

RAMLA as a specialised legal expert can solve such problems, just for a fraction in fees what you may miss out, if you don't have the right support.

In our view, it is not the correct way and get a legitimate claimant's demand, just been brushed away, isn't it?

Just take the time and contact, tell us about the matter and let us take care of it.

Defence against unreasonable or inflated claims?

RAMLA can help you most effectively to get a claim dropped or eased.

The results defending someone against whatever car accident compensation claim, can be very good, as often the evidence the Claimant do have is not sufficient to proof the claim, which is a pre-requisite for a successful action.

If it isn't as clear what the implications are and what evidence the other party/Insurance do have, chances are very good to stand through and get a claim successfully denied, even if a summons may have be served already.

The party alleges or accuses is forced to proof the claim and not the demanded party.

Many Insurance recovery claims fall short of such reliable evidence and therefore can be repudiated, even if it comes from attorneys or recovery agents.

However we do handle every substantial MVA claim,

against whatever party, Insurance, reluctant party or company successfully, given the merits of the issue are clear and stand a challenge.

Should the merits not be so favourable in the first place, we do all we can, improving such merits, to get the matter being a strong case.

Chances of success, if there is a strong case, and any other winning guarantees?

Those are questions we hear frequently, before a new client is prepared to accept some fees.

There cannot be any guarantee of success in legal matters, as the other party may have evidence matching or being better proof. If it comes to an action in a court of law, the presiding officer is the instance of weighting all brought forward in the action and decides.

However if sufficient evidence is at hand, chances are high to predict a win and succeeding with a matter, which ends up in an acceptable settlement/judgement.

You want to visit a local RAMLA office in your area and have a chat with one of our experts?

We are very sorry telling you, that we have chosen a different way of performing our business.

In order to hold overhead costs low, and not compromise on expertise and service, we have decided to act from one central, but not public office, in the Western Cape.

In order to hold fees low and offer very competitive rates, compared with similar legal services, we decided to concentrate intelligence and contain costs in this manner.

Anyone who likes to visit his/her adviser or attorney, should not choose RAMLA as a favourite, as we cannot or want honour just that.

But we can deliver the way we operate effectively, wherever you are in South Africa and with whom ever we have to deal, effectively, decisive and affordable.

What about fees, must they be paid upfront or can it be deducted from recoveries?

Let me answer the question in short.

Yes, all fees need to be paid up before we take action.

Why is that so?

Our fees are as competitive low, that we cannot enforce any such fees economically, if someone just take our services and thereafter give us hassles to pay.

Any local attorney will do the same, as asking for a deposit, commonly far higher than our entire fees are, upfront.

In general those deposits are offset against fee notes and further deposits requested in due course.

We dont do that. We deliver services not billed on time issues, but on performance phases, which gives cost certainty and the assurance to be taken care of the full matter.

Contact us to get more detailed information.

Any doubts about our capabilities or performance as this offer is an anonymous one on the web?

Well I must accept such doubts and can only point out and rely on the many we served before and who may be contactable for reference.

Check out what we display on our comprehensive web pages, which will back up our knowledge and experience without a doubt.

Anyhow we will never accept a mandate before we have had a first free analyse of your particular matter and if you aren't satisfied with our reply, simply don't go on with us, despite it may be detrimental to you.

We value a fair and open informative strategy, keeping a client updated, which will please most of those with an open mind to comunication technologies, such as email etc.

But we can only do what we offer and if you aren't happy with such offer, just get into contact with your local lawyer, or ask us to refer you to someone with specialised knowledge in MVA matters.

Should you have been through all before . . .

and still think we can be the one to solve your motor vehicle accident compensation problem in South Africa, just get in contact with us.
